GENERAL CONDITIONS OF SALE
Protein Systems SA and its affiliated companies provide products and services, in particular through the "Eurodiet.com" website. The purchase and/or use of Eurodiet products and services, Eurodiet mobile applications and associated Eurodiet software are subject to the following terms and conditions.
These General Terms and Conditions of Sale (GTC) apply to all products, equipment and services ("Non-Functional Balance" goods) offered or supplied by Eurodiet and its affiliated companies to buyers.
These General Terms of Sale govern the purchase process involving you and Protein System. Eurodiet is a brand belonging to Protein System SA.
Please read these terms carefully before placing any order with Protein System SA. Before ordering, the buyer declares that:
- The products purchased on the Eurodiet website have no direct connection with his professional activity and are strictly intended for personal use.
- Has full legal capacity to commit to these GTS.
Eurodiet reserves the right to modify these general conditions of sale at any time.
- OUR CONTRACT
When you place your order, we'll send you a confirmation email and let you know when the items are shipped.
Please note that we only sell our products in quantities appropriate for an average person's needs. This applies to the number of products per order and the number of orders placed by a single person (ie quantities of the same product usually ordered by a normal person).
- RIGHT OF RETENTION
The ordered goods remain the property of Eurodiet until they are duly paid for by the customer and handed over to the transport company.
- RETURNS
With the exception of fresh produce, all goods may be returned for a refund at the buyer's expense and within seven days of receipt. Boxes must arrive unopened, undamaged and in original condition. All returns should be sent to:
Eurodiet/Protein System, Rue de l'Industrie 44, L-8069 Bertrange, LUXEMBOURG.
Products must be returned in their original packaging, in perfect condition, ready for resale. The delivery note must also be attached, with a handwritten "return note" on it.
- PRICES AND AVAILABILITY
All prices include tax and exclude delivery charges unless otherwise stated.
All goods are payable upon order. Amounts paid to us will never be treated as deposits or advances. All orders are payable in Euros.
In the event of non-payment of any amount due by the Customer, or any adverse payment circumstances, Eurodiet Retail UK Ltd reserves the right to suspend or cancel any order and/or delivery, regardless of their nature or status.
The availability of products for sale on our website is indicated on each product sheet. We cannot provide more detailed information about product availability. If a product is not available when we process your order, we will notify you by email and the product in question will not be invoiced.
Despite our best efforts to correct, some products in our catalog may be incorrectly priced. All prices are systematically checked when we process your order and before payment. If we have made a mistake in the price shown on our website, we will ask you for confirmation if the correct price is higher and bill you the lowest price if the correct price is cheaper.
- CUSTOMS
If the products you order are to be delivered outside the European Union, they may be subject to import duties and/or other customs duties, recovered upon delivery of the product. These additional fees and charges are beyond our control and are payable by the buyer. As customs policies vary considerably from country to country, you may wish to contact your local customs for further information. Furthermore, please note that when you order goods from the Eurodiet website, you officially become their importer; Therefore, you must comply with the relevant laws and regulations of the country where you receive the goods. Our customers' right to privacy is a major concern for us and we would like to remind our international customers that cross-border deliveries may be opened and examined by customs. - ORDER FROM OUR WEBSITE
The website is the fastest, safest and easiest way to order Eurodiet products. If you are using a public or shared computer, we strongly recommend that you log out of the site and delete your ID and password after ordering.
- OUR OBLIGATIONS
Benefit from the legal warranty against hidden defects and non-conformity of the product.
With the exception of goods delivered to Germany and Austria, we disclaim any responsibility if goods delivered to other countries do not comply with local legislation.
We undertake to act with all reasonable care and diligence ordinarily used in the profession when providing goods and services to our customers. However, in no way can we be held liable for delays or breaches of contractual obligations resulting from unforeseeable circumstances or force majeure (as defined by applicable laws) or any other cause beyond our control.
Protein System SA will not be liable for breach of contract in the event of a lack of stock or unavailability of the product due to force majeure, total or partial strikes or interruptions in postal services and/or any other means of transport/communication used.
Protein System SA Ltd will not be liable for any consequential damages that may arise in connection with the purchase of its products.
Protein System SA Ltd will not be liable for any loss of data or files. The purchaser is solely responsible for protecting its files and data.
The Eurodiet website contains information displayed by third parties and links to other websites. Eurodiet shall not be liable for any damages resulting from the use, access or inability to use either such third party information or these websites.
- APPLICABLE LAW
These General Conditions of Sale are subject to Luxembourg Law and the application of the Vienna Convention on Contracts for the International Sale of Goods is specifically excluded. Both the buyer and the supplier agree that any dispute arising out of the business relationship between them shall be subject to the non-exclusive jurisdiction of the courts of the city of Luxembourg, which means that, in relation to these Terms of Sale, you may bring legal action. in Luxembourg or in any other country in the European Union where you may live, to assert your consumer rights.
If any provision of these terms of sale is held to be invalid, void or unenforceable for any reason, this provision shall be deemed severable and the remaining provision shall remain in full force and effect.
- CHANGES IN SERVICES PROVIDED OR TERMS OF USE
We reserve the right to change our website, procedures, terms of sale (including this document) at any time. The applicable terms of sale are those in effect at the time of purchase, unless a governmental or administrative authority requires them to be changed (in which case, the changes may apply to previous orders you may have placed with us). If any provision of these terms of sale is held to be invalid, void or unenforceable for any reason, this provision shall be deemed severable and the remaining provision shall remain in full force and effect.
- MINORITY
We do not sell products to minors, except in cases justified by medical prescription. We sell products designed to be consumed and purchased by adults.
